What CrPC Section 173 covered
Requires every investigation to be completed without unnecessary delay and the officer in charge to forward a report, commonly called the chargesheet or final report, to the Magistrate empowered to take cognizance.
What changed in BNSS Section 193
BNSS Section 193 adds that the police must inform the informant or victim of the progress of the investigation within ninety days, including by electronic communication, and that the report and documents may be forwarded electronically. Further investigation during trial needs the court's permission and is to be completed within ninety days, extendable by the court.
Which law applies: CrPC or BNSS?
The BNSS came into force on 1 July 2024. Under Section 531 of the BNSS, an appeal, application, trial, inquiry or investigation that was pending immediately before that date is to be disposed of, continued, held or made under the CrPC as if the BNSS had not come into force. Courts have had to decide how this applies to cases that straddle the date, so check current case law for your facts.
