New criminal laws
IPC to BNS section list: old and new section numbers
The Bharatiya Nyaya Sanhita, 2023 replaced the Indian Penal Code, 1860 for offences committed on or after 1 July 2024. Most offences survive with the same ingredients, but almost every section number changed, several related sections were merged into one, and some punishments were revised. New offences in the BNS with no IPC section
Some BNS provisions create offences that the IPC did not contain, so they have no old section to map from.
- BNS Section 69: Sexual intercourse by employing deceitful means. Covers sexual intercourse obtained by deceit, including a false promise to marry made without intending to fulfil it.
- BNS Section 103(2): Murder by a group on specified grounds. Murder by five or more persons acting in concert on grounds such as race, caste, community, sex, language or personal belief.
- BNS Section 111: Organised crime. Continuing unlawful activity by a member of an organised crime syndicate, such as kidnapping, extortion, contract killing or economic offences.
- BNS Section 112: Petty organised crime. Theft, snatching, cheating and similar offences committed by a member of a group or gang.
- BNS Section 113: Terrorist act. Brings terrorist acts into the general penal code, alongside the Unlawful Activities (Prevention) Act, 1967.
- BNS Section 304: Snatching. Theft where the offender suddenly, quickly or forcibly seizes movable property from a person or from that person's possession.
Which law applies: IPC or BNS?
The BNS applies to offences committed on or after 1 July 2024. An offence committed before that date continues to be investigated, tried and punished under the IPC, because the repeal and savings clause in Section 358 of the BNS preserves liabilities and proceedings under the repealed Code.
