What IPC Section 375 covered
Defines rape by reference to the acts covered and seven descriptions of absence of consent, including consent obtained by fear, intoxication or misconception, and any act with a woman below eighteen years.
What changed in BNS Section 63
The definition is carried over. Exception 2 now refers to a wife "not being under eighteen years of age"; the IPC text said fifteen, which the Supreme Court had read as eighteen in Independent Thought v. Union of India (2017).

Which law applies: IPC or BNS?
The BNS applies to offences committed on or after 1 July 2024. An offence committed before that date continues to be investigated, tried and punished under the IPC, because the repeal and savings clause in Section 358 of the BNS preserves liabilities and proceedings under the repealed Code.
