    What IPC Section 376D covered

    Applies where a woman is raped by one or more persons constituting a group or acting in furtherance of a common intention. Each of them is deemed to have committed the offence.

    What changed in BNS Section 70(1)

    Section 70(1) keeps the same punishment. Section 70(2) replaces IPC Sections 376DA and 376DB with a single provision for gang rape of a woman under eighteen, punishable with imprisonment for the remainder of natural life and fine, or with death.

    Which law applies: IPC or BNS?

    The BNS applies to offences committed on or after 1 July 2024. An offence committed before that date continues to be investigated, tried and punished under the IPC, because the repeal and savings clause in Section 358 of the BNS preserves liabilities and proceedings under the repealed Code.
