What IPC Section 511 covered
The residuary attempt provision. It punishes an attempt to commit an offence punishable with life imprisonment or imprisonment, where the Code has no express provision for that attempt and some act is done towards commission of the offence.
What changed in BNS Section 62
The provision moves from the very end of the IPC to the front of the BNS, next to abetment and conspiracy. The punishment is the same.
Punishment: IPC 511 compared with BNS 62
The punishment is the same under both codes. Up to one-half of the imprisonment for life or one-half of the longest term provided for the offence, or the fine provided for the offence, or both.
Which law applies: IPC or BNS?
The BNS applies to offences committed on or after 1 July 2024. An offence committed before that date continues to be investigated, tried and punished under the IPC, because the repeal and savings clause in Section 358 of the BNS preserves liabilities and proceedings under the repealed Code.
