    What IPC Section 364A covered

    Punishes kidnapping or abducting a person, or keeping a person in detention after kidnapping, and threatening to cause death or hurt in order to compel the Government, a foreign State, an organisation or any person to do or abstain from an act or to pay a ransom.

    What changed in BNS Section 140(2)

    IPC Sections 364, 364A, 365 and 367 become the four sub-sections of BNS Section 140. The punishment for kidnapping for ransom is unchanged.

    The punishment is the same under both codes. Death, or imprisonment for life, and fine.

    Which law applies: IPC or BNS?

    The BNS applies to offences committed on or after 1 July 2024. An offence committed before that date continues to be investigated, tried and punished under the IPC, because the repeal and savings clause in Section 358 of the BNS preserves liabilities and proceedings under the repealed Code.
