What Evidence Act Section 65B covered
Makes a computer output admissible as a document without production of the original if the listed conditions are met, and provides for a certificate identifying the electronic record and describing how it was produced.
What changed in BSA Section 63
BSA Section 63 keeps the certificate requirement and extends the provision to semiconductor memory and any communication device. The certificate is now to be signed both by the person in charge of the device or the relevant activities and by an expert, in the form set out in the Schedule to the Adhiniyam.
Which law applies: Evidence Act or BSA?
The BSA applies from 1 July 2024. Under Section 170 of the BSA, an application, trial, inquiry, investigation, proceeding or appeal that was pending immediately before that date continues to be governed by the Indian Evidence Act, 1872.
