What Evidence Act Section 133 covered
Provides that an accomplice is a competent witness against an accused person, and that a conviction is not illegal merely because it proceeds upon the uncorroborated testimony of an accomplice.
What changed in BSA Section 138
BSA Section 138 restates the rule with a change of emphasis: a conviction is not illegal if it proceeds upon the corroborated testimony of an accomplice. Read it with illustration (b) to Section 119, which carries the old caution about accomplice evidence.
Which law applies: Evidence Act or BSA?
The BSA applies from 1 July 2024. Under Section 170 of the BSA, an application, trial, inquiry, investigation, proceeding or appeal that was pending immediately before that date continues to be governed by the Indian Evidence Act, 1872.
