    What Evidence Act Section 113A covered

    Allows the court to presume that the husband or his relative abetted the suicide of a married woman if she committed suicide within seven years of marriage and had been subjected to cruelty by them.

    What changed in BSA Section 117

    The presumption is carried over as BSA Section 117. "Cruelty" now takes its meaning from Section 86 of the BNS in place of Section 498A of the IPC.

    The BSA applies from 1 July 2024. Under Section 170 of the BSA, an application, trial, inquiry, investigation, proceeding or appeal that was pending immediately before that date continues to be governed by the Indian Evidence Act, 1872.
