    What Evidence Act Section 113B covered

    Requires the court to presume that a person caused a dowry death if it is shown that soon before her death the woman was subjected by that person to cruelty or harassment for, or in connection with, a demand for dowry.

    What changed in BSA Section 118

    The presumption is carried over as BSA Section 118. "Dowry death" now takes its meaning from Section 80 of the BNS in place of Section 304B of the IPC.

    The BSA applies from 1 July 2024. Under Section 170 of the BSA, an application, trial, inquiry, investigation, proceeding or appeal that was pending immediately before that date continues to be governed by the Indian Evidence Act, 1872.
